These Terms & Conditions apply to the use of the website bcefilms.eu and its content, as well as to all contracts concluded via bcefilms.eu for paid access to digital film content.
1. Scope
These Terms & Conditions of bce films & more GmbH (hereinafter "bce films"), Occamstraße 6, 80802 Munich, Germany, represented by its managing director Bettina Ehrhardt, apply both to the use of the website bcefilms.eu and its content by all visitors (Section 2), and to all contracts concluded via bcefilms.eu with consumers (§ 13 BGB) for paid streaming access to films, as well as to voluntary contributions in support of films made available free of charge (Section 5).
These Terms & Conditions are provided in German (authoritative) and English (for information). In the event of any discrepancy, the German version prevails.
2. Copyright and rights of use
The content of this website – in particular photographs, texts, graphics, film stills and videos – is protected by copyright unless otherwise indicated. The rights are held by bce films or by the respective rights holders identified in connection with the content.
Any use beyond viewing the content for its intended purpose – in particular downloading, reproducing, editing, distributing, making publicly accessible or publishing the content – requires the prior written consent of bce films or the respective rights holder, unless such use is permitted by law, for example under the statutory right of quotation.
Individual content – in particular photographs – may contain information about authorship or the respective rights holder, or may be subject to separate licence terms. In such cases, the rights of the respective authors or other rights holders apply.
The name "bce films & more" and the bce films & more logo may not be used without prior written consent unless such use is permitted by law.

3. Conclusion of contract
By clicking the order button that indicates an obligation to pay, the customer submits a binding order for the selected film access. Payment is processed through the payment service provider Stripe. The contract is concluded upon successful completion of the payment.
bce films confirms the conclusion of the contract by email and provides the personal access link to the selected film.
The contract may be concluded in German or English; the text of the contract will not be stored.
Before submitting the order, the customer expressly agrees that bce films may begin providing access to the film before expiry of the withdrawal period and confirms their awareness that the right of withdrawal expires once provision begins. The consent and acknowledgement are recorded in the contract confirmation. Further details are set out in Section 8.
4. Streaming access
bce films offers three types of streaming access to films available on the website:
72-Hour Streaming: Once your personal access has been provided, you may start the film for the first time within 30 days. From the time you first start the film, you have 72 hours to watch it as often as you wish. Access ends once these periods have expired.
Long-Term Streaming: Once your personal access has been provided, you may watch the film as often as you wish for at least three years. bce films will continue to provide access beyond this period for as long as the streaming offer for the film remains available; the minimum period of three years is unaffected by this.
Would you like to support our work? The scope and duration are the same as for Long-Term Streaming. Your contribution helps bring our new projects to life.
Purchasing streaming access does not transfer ownership of the film or any additional rights of use: streaming access is personal and non-transferable. It entitles you solely to view the selected film privately. Downloading, permanent storage, reproduction, sharing, public screening or any other public communication of the film is not permitted.
bce films is entitled to change the streaming service used to provide the film, provided that the customer's access to the film is not impaired as a result.
5. Prices and payment
The prices applicable at the relevant time are stated on the respective film page and are shown in euros or in the currency offered for the relevant country.
For consumers in Germany, the displayed price includes statutory VAT. Depending on the country, the applicable tax may already be included in the displayed price or may be added at checkout. The total price, including any applicable taxes, is displayed for the selected film and again before the order is completed.
Payment is processed via Stripe Managed Payments. Link acts as the merchant of record for the transaction. Link collects the purchase price, including any applicable taxes, and remits the relevant taxes to the competent tax authorities.
The payment methods available at checkout are displayed during the ordering process. Payment becomes due upon completion of the checkout process and is collected immediately.
The payment receipt is provided via Stripe and identifies Link ("Sold through Link") as the merchant of record. The name and logo of bce films identify the film offering. Streaming access to the film is provided by bce films on the basis of these Terms & Conditions.
Voluntary contributions
bce films makes certain films available for streaming free of charge on bcefilms.eu. In connection with these films, you may make a voluntary contribution to bce films, either in the fixed amount offered or in an amount chosen by you.
The contribution is made without any consideration in return. The film concerned remains equally freely accessible to all users before and after payment; the contribution does not provide access, additional or early-access content, any discount, acknowledgement or any other service from bce films. The contribution does not create a contract for the provision of digital content; Sections 3, 4 and 7 of these Terms & Conditions do not apply to contributions.
As no service is provided by bce films in return for the contribution, the contribution is not charged as consideration and VAT is therefore not shown. bce films is not recognised as a charitable organisation within the meaning of §§ 51 ff. AO; no donation receipt (Zuwendungsbestätigung) can be issued, and the contribution cannot be deducted for tax purposes as a donation.
There is no statutory right of withdrawal for contributions because the provisions governing withdrawal from consumer contracts (§§ 312 ff., 355 BGB) require a contract concerning a service supplied for consideration. Irrespective of this, bce films will refund a contribution in full if you send an informal request to bce@bcefilms.com within fourteen days of payment.
By way of exception to the preceding paragraphs of this Section, contributions are not processed through Stripe Managed Payments; Link does not act as merchant of record in this respect. Payment is collected through Stripe on behalf of bce films; the payment receipt is provided by Stripe.
6. Provision and technical requirements
To use the streaming service, you need a stable internet connection and an up-to-date web browser. Playback is available on desktop computers as well as on commonly used smartphones and tablets via an up-to-date web browser.
Playback quality and functionality may be affected by your device, the operating system used, the browser version and the quality of your internet connection.
If a technical fault means that you were unable to watch the film, or were unable to watch it in full, within the booked access period, please contact bce@bcefilms.com.
Your personal access link is automatically sent to the email address provided during the ordering process once payment has been confirmed. If you do not receive the email, please contact bce@bcefilms.com, stating the email address used for the order.
Temporary disruptions to the streaming platform that are beyond the control of bce films may affect the availability of the streaming service. The customer's statutory rights where the digital content is not provided or is provided defectively remain unaffected.
7. Rights of use
The access link is personal and non-transferable. It may be used exclusively by the purchaser for private, non-commercial purposes. Sharing the link with third parties, as well as any reproduction, distribution, making available to the public or other exploitation of the film, is not permitted.
8. Right of withdrawal

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date on which the contract is concluded.
To exercise your right of withdrawal, you must inform us (bce films & more GmbH, Occamstraße 6, 80802 Munich, Germany, email: bce@bcefilms.com) of your decision to withdraw from this contract by means of an unequivocal statement – for example by post or email. You may use the model withdrawal form below, but this is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Expiry of the right of withdrawal
Your right of withdrawal expires as soon as we have begun providing the film and thus begun performance of the contract, after you have expressly agreed that performance of the contract may begin before expiry of the withdrawal period and have confirmed your awareness that, by giving this consent, you lose your right of withdrawal (§ 356(6) BGB) once performance begins.
We obtain this consent and confirmation before the order is completed by means of a corresponding checkbox. You will receive confirmation of this together with the contract confirmation by email.
Effects of withdrawal
If you withdraw from this contract, we must reimburse all payments received from you without undue delay and no later than fourteen days from the date on which we receive notification of your withdrawal. We will use the same means of payment for this reimbursement as you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees as a result of the reimbursement.

9. Liability for defects
The statutory provisions governing liability for defects in digital products (§§ 327 ff. BGB) apply to the provision of the digital content.
In the event of technical faults, we will take appropriate measures within the scope of our statutory obligations to restore access to the film.
10. Limitation of liability
bce films is liable without limitation for damage caused intentionally or through gross negligence. In cases of ordinary negligence, bce films is liable only for breach of a material contractual obligation; in such cases, liability is limited to the foreseeable damage typical for this type of contract.
The above limitations of liability do not apply to damage arising from injury to life, body or health, or to claims under the German Product Liability Act.
11. Applicable law and jurisdiction
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). For consumers resident in the European Union, the mandatory consumer-protection provisions of the law of their respective country of residence remain unaffected.
Jurisdiction for consumers is governed by the statutory provisions. For merchants and legal entities, Munich is the exclusive place of jurisdiction.
12. Final provisions
If individual provisions of these Terms & Conditions are or become wholly or partly invalid, the validity of the remaining provisions remains unaffected. The statutory provisions shall apply in place of the invalid provision.
